In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhangore Police Station Case No. 388 of 2019 dated 11.07.2019 under Sections 376DA/506 of the Indian Penal Code and Section 6 of the POCSO Act.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 7 years and 2 months and till date out of 17 witnesses cited by the prosecution only 4 witnesses have been examined.
Learned advocate for the State opposes the prayer for bail.
Having considered the long detention of the present petitioner and without entering into the merits of the case, I am inclined to release the petitioner on bail.
Accordingly, prayer for bail of the petitioner is allowed.
2 Accordingly, Petitioner shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, Special Court (POCSO Act), Baruipur, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of South 24 Parganas without the prior permission of the learned Trial Court.
Additionally, petitioner shall not enter the jurisdiction of Bhangore Police Station till further orders passed by the learned Special Court which would include the completion of the evidence of the vulnerable witnesses.
With the aforesaid observations CRM (M) 1838 of 2026 is allowed.
Memo of Evidence submitted be kept with the record.
