For Petitioner : Mr.N.Ananda Kumar For Respondents : Mr.I.Pinaygash (R1 & R2) counsel for State 1/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.17732 of 2026 ORDER The present Writ Petition has been filed seeking a Writ of Mandamus directing the official respondents to survey and demarcate the petitioner's property. 2.By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. 3.Mr.I.Pinaygash, learned counsel for the State, accepts notice on behalf of the respondents 1 and 2. Considering the limited relief sought by the petitioner, notice to the third respondent is dispensed with. 4.The petitioner claims title to the property comprised in Survey No.362/3B2, measuring an extent of 0.40.48 ares, covered under Patta No.8078, and Survey No.362/2A1A1A2, measuring an extent of 0.08.93 ares, covered under Patta No.8275, respectively. The petitioner submits that she purchased the said properties under a 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.17732 of 2026 registered Sale Deed bearing Document No.2893 of 2007 dated 04.06.2007 from one T.Saravanan, who acted as the power agent of the legal heirs of late Arumugam Moopan, namely, Sengulathan, Shanmugam, Subramaniyan, Kulanthaivel, Krishnan, Murugesan, Chandrasekar, Ramesh and Balu. The said power of attorney was registered as Document No.319 of 1996 dated 14.03.1996. 5.The petitioner further submits that a Rectification Deed dated 09.10.2007 was subsequently executed, as the total extent of the property had been erroneously mentioned as 11,310 square feet instead of 10,725 square feet in the original Sale Deed. Based on the said Sale Deed, the petitioner claims to be in possession and enjoyment of the property. According to the petitioner, the third respondent, who belongs to the vendors' family, is interfering with the petitioner's peaceful possession and enjoyment of the property. Hence, the petitioner has filed the present Writ Petition seeking a direction to the official respondents to survey and demarcate the subject property. 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.17732 of 2026 6.Considering the facts and circumstances of the case, this Court directs the first respondent to conduct a survey and demarcate the property. If the Tahsildar requires police protection for conducting the survey, the jurisdictional police shall provide the necessary assistance. 7.In the event the petitioner seeks installation of boundary stones, the same shall be carried out at the petitioner's cost. 8.This Court further directs the official respondents to adhere to the following Standard Operating Procedure: (a) The official respondents shall issue notice to the petitioner before commencing the survey proceedings at the site. The petitioner shall acknowledge receipt of such notice by affixing his signature. (b) Upon completion of the survey, the petitioner shall again affix his signature acknowledging that the survey has been conducted and indicating whether he is satisfied with the same. 4/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.17732 of 2026 (c) In the event the petitioner is not satisfied with the survey, he shall nevertheless affix his signature recording his dissatisfaction or protest and shall state the reasons therefor. The aforesaid procedure shall be strictly followed by all concerned. The entire exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order. 9.With the above directions, this Writ Petition stands disposed of.
