Adak, … for the State. 1. The writ petitioner and the respondent State are represented by their respective learned advocates. 2. By filing the instant writ petition, the writ petitioner has prayed for issuance of appropriate writ/writs against the respondent authorities, more specifically against the respondent no. 6 authority, to consider the representation dated 11.07.2014 as submitted by the writ petitioner in accordance with law. 3. At the time of hearing, Mr. Halder, learned advocate appearing on behalf of the writ petitioner, draws the attention of this Court to the order dated 01.08.2024 as passed by this Court in this writ petition. 4. It is submitted by Mr. Halder that on the said date, that is on 01.08.2024, this Court has recorded 2 the submission of the State that the subject matter of the instant writ petition is akin to the subject matter as decided by an Hon'ble Special Bench of this Court vide judgment dated 20.06.2023 in MAT No. 1518 of 2019 (State of West Bengal & Ors. vs. Sabita Roy & Ors.). 5. It is submitted by Mr. Halder that on 01.08.2024, this Court recorded that challenging the said judgment dated 20.06.2023, an SLP was preferred. 6. In course of his submission, Mr. Halder places a server copy of the order dated 12.12.2024 as passed in the Special Leave Petition (Civil) Diary No(s). 30809 of 2024 (The State of West Bengal & Ors. Vs. Sabita Roy & Ors.) by the Hon'ble Supreme Court, wherefrom it reveals that the said Special Leave Petition is dismissed. 7. It is thus, submitted by Mr. Halder that appropriate relief or reliefs may be granted to the writ petitioner in terms of the prayers made in the instant writ petition. 8. Mr. Agarwal, learned advocate appearing on behalf of the respondent State, in his usual fairness submits before this Court that the respondent no. 6 authority may be directed to consider the writ petitioner's representation dated 11.07.2014 in accordance with the law as well as in the spirit of the judgment of the Hon'ble Full Bench of this Court in 3 MAT No. 1518 of 2019 and the order passed in the said SLP. 9. In view of such, this Court, while disposing of the instant writ petition, directs the respondent no. 6 authority to consider the representation dated 11.07.2014 submitted by the writ petitioner in accordance with law and after giving the opportunity of hearing to the writ petitioner and/or his authorized representative, shall pass a reasoned order in the light of the judgment dated 20.06.2023 passed in MAT No. 1518 of 2019 and the order dated 12.12.2024 as passed by the Hon'ble Supreme Court in the Special Leave Petition (Civil) Diary No(s). 30809 of 2024 (The State of West Bengal & Ors. Vs. Sabita Roy & Ors.) and to communicate the said reasoned order to the writ petitioner, preferably by e- mail if the e-mail details of the writ petitioner are communicated to him at the time of hearing. 10. The entire exercise as indicated hereinabove is to be completed by the respondent no. 6 authority within 60 working days from the date of communication of the server copy of this order along with a copy of the representation dated 11.07.2014. 11. The time limit as fixed by this Court is peremptory and mandatory. 12. With the aforesaid observations, W.P.A. 20441 of 2014 is disposed of. 4 13. Before parting with, it is, however, made clear that while disposing of the instant writ petition, this Court has not gone into the merits of the order dated 11.07.2014 and thus all points are kept open for adjudication by the respondent no. 6 authority. 14. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Partha Sarathi Sen , J.)
