Petitioner is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail in SC No.83/2026 pending before the Court of II Addl. District and Sessions Judge, Tumakuru, arising out of Crime No.80/2020 registered by New Extension Police Station, Tumakuru, for the offences punishable under Section 395, 397, 109, 120B and 201 of IPC. 2. Heard the learned counsel for the parties. 3. Learned counsel for the petitioner submits that in the present case he was earlier arrested and subsequently granted regular bail. However, for the reasons beyond his control, petitioner could not attend the Court after 06.11.2025 and therefore, non-bailable warrant has been issued against him. He submits that this petition may be dismissed as not pressed with liberty to the petitioner to surrender before the Trial Court and file necessary application seeking regular bail. He submits that considering the aforesaid aspects of the matter, the Trial - 3 - HC-KAR CNR: KAHC010611912026 NC: 2026:KHC:51505 CRL.P No. 13671 of 2026 Court may be directed to consider his regular bail application on the same day. Learned HGCP does not seriously oppose the said prayer made by learned counsel for the petitioner. Under the circumstances, the following order:- 4. The criminal petition is dismissed as not pressed with liberty as prayed for. In the event, petitioner surrenders before the Trial Court and files necessary application seeking regular bail, such application shall be considered and disposed off on merits in accordance with law, on the same day.
