In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kharibari Police Station case no. 190 of 2025 dated 09.07.2025 under Sections 21(c) of the NDPS Act.
And In the matter of : Md. Karim
……Petitioner. Mr. Apan Saha
......for the Petitioner. Mr. Avrojyoti Das, Ld. APP Mr. Bapi Sarkar Mr. Mayank Bhandari
……for the State.
Learned advocate appearing for the petitioner submits that there has been alleged recovery of 50 bottles of codeine mixtures and petitioner is in custody for 470 days, although, charge-sheet has been submitted but the trial has not progressed substantially. Learned advocate appearing for the State opposes the prayer for bail. Having considered the quantum of recovery in the present case, at this stage, I am not inclined to release the petitioner on bail. Petitioner will renew his prayer for bail after the evidence of independent seizure list witnesses are over. As such prayer for bail of the petitioner in CRM (NDPS) 575 of 2026 is dismissed at this stage.
