Heard the learned counsel appearing for the petitioners and the learned High Court Government Pleader for respondent No.1-State.
2. The petition is filed to quash the Crime No.279/2026 registered before the T. Narasipura police station. Petitioners are accused No.1 to 3. Digitally Signed by ANANT RAMNATH HEGDE

3. The offences under Section 54, 115(2), 118(1), 351(2) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 ('BNS').

Learned counsel appearing for the petitioners would submit that petitioner no.1 had filed a complaint against the husband and other relatives of respondent no.2. Same is registered in Crime No.277/2026. As a counter blast to the said complaint, next day the present complaint is filed making false allegations.

Learned counsel for the petitioner would submit that the petitioner No.1 has suffered serious injury and it is mentioned in the complaint and also photographs are produced. It is submitted that petitioners no.2 and 3 were in Bangalore on the date of the alleged incident and that is captured in CCTV, where petitioners are working. Despite this, it is the contention that the FIR is registered against the petitioners and investigation is going on. Digitally Signed by ANANT RAMNATH HEGDE

Learned counsel for the petitioner would also submit that because of the political pressure investigation is not proceeding further in the complaint filed by the petitioner no.1.
7. The Court has considered the contentions raised and perused the records.

If the petitioners no.2 and 3 were not present at the time of alleged incident and they were elsewhere and their presence is captured in a CCTV camera as contended by the petitioners, it is the responsibility of the Investigating Agency to collect those materials and to verify the same and to take further action as advised in law.
9. The petitioners may not be in a position to furnish those records. However, the Investigating Agency will have to collect those materials and they have to verify the same.

Learned counsel for the petitioners submits that, they will produce the CCTV footage. If it is produced, same shall be verified in accordance with law. However, considering the contents of the complaint, the Court is also of the view that Digitally Signed by ANANT RAMNATH HEGDE

the complaint cannot be quashed at this juncture. The police have to investigate the matter.
11. Under these circumstances, the petition is dismissed with the above-mentioned observations.
12. Merely because the petition is dismissed, it does not mean that the Court has accepted the allegations against the petitioners.
13. Whether the allegations are true or not has to be verified after thorough investigation. The police shall investigate both complaints and file appropriate report.
