ORAL ORDER
1. Accused No.1 in Crime No.97/2026 registered by Anandapura Police Station, Shivamogga, for the offences punishable under Sections 318(4) and 190 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.97/2026 was registered by Anandapura Police Station, Shivamogga, for the aforesaid offences against the petitioner and five others. In the said case, petitioner was arrested on 05.08.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.10194/2026 was rejected on
24.08.2026. Therefore, he is before this Court. 4. In the first information submitted by one Jagadisha, it is stated that on 01.06.2021, he had received a phone call and the caller informed him that he has found a treasure in his property and he was interested in selling the gold coins which

was with him, for a lesser rate. Therefore, first informant and his nephew Manoj went to Harihara to meet the said persons, who allegedly had asked them to come near Nilagunda. When the first informant and his nephew went to Nilagunda, two persons, who came there, showed him gold coins and after checking the genuineness of the said gold coin, he had handed over the same to them. Thereafter, the said persons had asked him to bring Rs.10 lakhs on the assurance that they will hand over half kg gold coins to him. 5. Accordingly, first informant borrowed Rs.10 lakhs from a financial company and thereafter, met the aforesaid two persons on 04.06.2026. When the first informant was showing money to said persons, four persons, who came there started abusing them for the reason that they were doing some drug business. Two persons amongst them snatched the bag containing cash from the first informant and ran away. It is in under these circumstances, FIR was registered against Manju and unknown others. During the course of investigation, petitioner was arrested and remanded to judicial custody. Major portion of the investigation is already completed. Maximum

punishment for the alleged offences is imprisonment for a period of seven years.
It is not in dispute that petitioner has no other criminal antecedents. The money which was snatched from the custody of the first informant has been recovered in the present case. Under the circumstances, the following
order:-
6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.97/2026 registered by Anandapura Police Station, Shivamogga, for the offences punishable under Sections 318(4) and 190 of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
