JUSTICE ANANT RAMANATH HEGDE ORAL ORDER Heard the learned counsel for the petitioners and the learned High Court Government Pleader for respondent No.1. 2. This petition is filed to quash the proceedings in C.C.No.1120/2026 and the FIR and complaint registered in Crime No.133/2025 before the Alanahally Police Station, Mysuru, for the offences punishable under Sections 108 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. It is submitted that the matter has now been committed to the jurisdictional Sessions Court. 3. Learned counsel appearing for the petitioners would submit that, the deceased allegedly made a statement on social media stating that the petitioners are responsible for his death. It is the submission that the said statement was made while the deceased was in a highly intoxicated state and therefore, such statement cannot be accepted. In addition, it is also submitted that the petitioners had taken care of the deceased and had met all his demands and needs. Thus, it is the contention of the petitioners that the prosecution amounts to a gross abuse of process of the Court. 4. Learned High Court Government Pleader would submit that, after investigation, the charge-sheet has been filed. The social media posting made by the deceased from his own account clearly demonstrates that the petitioners are responsible for the death of the deceased, as deceased has named all the petitioners, as such, the contention of the petitioners cannot be accepted to quash the proceedings. It is further submitted that the contents of the charge-sheet prima facie disclose the ingredients of the offence. Hence, the matter requires trial. 5. The Court has considered the contentions raised and perused the records. From the charge-sheet materials, it is evident that there was a post on Facebook, allegedly made by the deceased, wherein he has named the petitioners as responsible for his suicide. The police, after investigation, have filed the charge-sheet and on considering the charge-sheet Digitally Signed by ANANT RAMNATH HEGDE - 5 - HC-KAR CNR: KAHC010561882026 NC: 2026:KHC:51352 CRL.P No. 12399 of 2026 material, the Court is of the view that the ingredients of the offences are made out. 6. Whether the petitioners are really responsible for the death of the deceased or someone else is responsible for the death of the deceased or whether the deceased committed suicide in a spur of a moment without there being any act attributable to the petitioners, is a matter which requires to be considered by the Trial Court after the evidence is led by the parties. 7. Under the circumstances, at this juncture, the petition cannot be entertained to quash the proceedings. Accordingly, the petition is dismissed. 8. Merely because the petition is dismissed, it cannot be construed that the Court has expressed any opinion on the merits of the prosecution case. 9. All contentions are kept open to be considered by the trial Court.
