This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Civil Judge (Junior Division), 2nd Court at Barasat, to dispose of the injunction application under Order 39 Rule 1 and 2 of the Code of Civil Procedure in connection with Title Suit No. 867 of 2026, expeditiously. From the order sheets appended to this application, this Court finds that 9th September, 2026 was fixed for hearing of the temporary injunction application and for acceptance of written statement-cum-counter claim. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned advocate for the petitioner, this civil revision application is disposed of by requesting the learned Civil Judge (Junior Division), 2nd Court at Barasat, to take up the hearing of the temporary injunction application on the next date fixed, if the same is otherwise ready for hearing and make an endeavor to
2 dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
