POONACHA ORAL ORDER Writ Petition No.3468/2026 is filed seeking for the following reliefs: "a) To issue writ of mandamus directing respondent no.4 to grant police protection to the petitioner for demolish of the structure in the schedule property and thereby quash the endorsement with respect of ANNEXUE-E. b) Pass such other order/s as this Hon'ble court may deem fit in the interest of justice and equity." 2. Writ Petition No.15867/2025 is filed seeking for the following reliefs: "a) Issue a writ in the nature of Mandamus considering Annexure A and dated 18/07/2024 and 27/3/2025 directing A1 the 7th respondent to deliver the possession of the property in A.V.R Road, J.C Extension, Kanakapura Town, Kanakapura Taluk, Ramanagara District bearing municipal Katha No. 1383/6545 measuring East to West 30 feet and North to South 15 Feet consisting of Mangalore tiled house. b) Grant such other relief that this Hon'ble Court may deem fit in the facts and circumstances of the matter." The essence of the grievance articulated in both the petitions is that pursuant to the Sale Deed dated 16.08.2019 (Annexure-A to the writ petition) executed by the Karnataka State Financial Corporation1, the possession of the property was not handed over to the petitioner. It is forthcoming that pursuant to the order dated 17.11.2025 passed in WP No.15867/2025 (Annexure-B to the writ petition) the petitioner has been put in possession of the property purchased by him from KSFC and a possession certificate dated 19.11.2025 has also been issued. 4. The impleading applicant in WP No.15867/2025 seeks to contend that the petitioner has sold the property vide registered Sale Deed dated 05.07.2022 and he has no subsisting right, title or interest to maintain the petition. Accordingly, the petitions stand disposed of. 7. The grievance of the parties, if any, as to any right, title and interest, qua the properties in respect of which they seek to assert the same is to be adjudicated in appropriate proceedings to be initiated before the Civil Court of competent jurisdiction and the same are not be adjudicated in proceedings under Article 226 of the Constitution of India.
