Goswami, Advocate For the O.P.No.1 :- Mr. Nanhu Ram, Advocate ---- 2/09.01.2026 This CMP has been filed for restoration of the First Appeal No.16 of 2014 which was rejected on 20.12.2019 for non compliance of part of the order dated 22.11.2019. 2. Learned counsel for the petitioner submits that I.A. was not filed for substitution of legal heirs/ successors of respondent no.2 and further extension was provided to file substitution however the same was not filed and in view of that the said FA was dismissed for default. He next submits that notice has been issued against the O.P.No.1 and 2 in the present CMP. 3. Mr. Nanhu Ram, the learned counsel appearing for the -1- OP No.1 is present and he submits that he has appeared on behalf of the O.P.Nos.1 and 2. He next submits that the legal heirs/ successors of late Choka Manjhi is made O.P in the present CMP as respondent no.2. He further submits that he has got no serious objection if the said FA is restored to its original file. 4. In view of above and considering that due to peremptory order the said FA was dismissed for default and was not decided on merit and now the legal heirs/ successors of late Choka Manjhi has been made party in the present CMP as O.P.No.2 and he is being represented by Mr.Nanhu Ram, the learned counsel. 5.
