JUSTICE D K SINGH) The present contempt petition has been filed alleging non-compliance and willful disobedience of the judgment and order dated 13.02.2023 passed in W.P. No.2735/2023 filed by the complainant. 2. The order dated 13.02.2023, which is alleged to have been disobeyed, reads as under: "The petitioner is before this Court seeking a direction to consider the representation dated 09.11.2022 submitted to respondents No.1 to 3 and seeking action by the respondents in terms of the provisions of the Karnataka Protection of Interest of Depositors in Financial Establishment Act, 2004 ('Act' for short). 2. The petitioner submits a representation on 09.11.2022 and 20.12.2022 alleging that the authorities are not taking any action under the act against respondent No.5. 3. The learned AGA would submit that if reasonable time is granted action would be taken in accordance with law and the standard operative procedure in place for consideration of the grievances of the petitioner and the like, considering the same, appropriate orders would be passed in accordance with law. 4. The submission is placed on record. 5. The petition is disposed on the said submission to act strictly in consonance with the provisions of law and standard operative procedure in place such action to be taken under the Act. 6. The action shall be taken in terms of the representation within an outer limit of six weeks, if not earlier. - 4 - HC-KAR CNR: KAHC010152012024 NC: 2026:KHC:52386-DB CCC No. 296 of 2024 Ordered accordingly." 3. Pursuant to the notice issued to the alleged contemnor, several affidavits have been filed. The last of such affidavits is dated 12.02.2026. Paragraph No.4 of the said affidavit reads as under: “ 4. I submit that based on the said report, the Principal secretary to Government, Revenue Department, submitted a proposal to the Government on 18.03.2024 for initiatin of proceedings under Section 3(2) of the KPID Act against Kamalakshi Multi-Purpose Co-operative Society (Regd.) Thereafter, on 21.03.2024, the Government issued a notification ordering attachment of the name of the accused society; appointed the Deputy Registrar of Co-operative Societies, Udupi District, as the Competent Authority; published a Gazette Notification to the said effect. An endorsement communicating the above action was issued to the petitioner on 25.03.2024.” 4. From the aforesaid affidavit and the material placed on record, it is evident that, pursuant to the directions issued by this Court, various steps have been taken under the provisions of the Karnataka Protection of Interest of Depositors in Financial Establishment Act, 2004 for protecting the interests of the members of the petitioner-society who had deposited the amount with Kamalakshi Vividhoddesha Sahakara Sangha Ltd., - 5 - HC-KAR CNR: KAHC010152012024 NC: 2026:KHC:52386-DB CCC No. 296 of 2024 5. Having regard to the steps taken by the alleged contemnor, we are of the considered view that the directions contained in the order dated 13.02.2023 have been complied with. The material on record does not establish any deliberate or willful disobedience of the orders of this Court. In view of the aforesaid circumstances, the contempt petition does not survive for further consideration. Accordingly, the contempt petition is dismissed.
