Heard learned counsel appearing for the petitioner and learned High court Government Pleader appearing for respondent No.1.
2. This petition is filed to quash the proceedings in C.C. No.490/2023 pending before IV Additional Civil Judge and JMFC Anekal, arising out of Crime No.401/2022 registered by the Hebbagodi Police Station for the offences punishable under Sections 341, 504 and 506 of the Indian Penal Code, 1860.

Learned counsel appearing for the petitioner would submit that the charge-sheet materials do not indicate any cognizable offence and a false case has been filed against the petitioner. Thus, it is the contention that the proceedings have to be quashed as it is an abuse of the process of the Court.
4. Learned High Court Government Pleader appearing for respondent No.1 would submit that the complaint has been registered and the investigation has been carried out in accordance with law. There are eyewitnesses to the alleged incident. The petitioner is alleged to given a life threat to the complainant by holding a weapon in his hand. Thus, would urge that the petition has to be dismissed.

Learned counsel appearing for the petitioner would submit that the alleged weapon said to have been held by the petitioner at the time of alleged incident has not recovered. No seizure panchanama is drawn, as such, the prosecution is untenable.

Learned counsel appearing for the petitioner would further submit that, in the further statement of the complainant, the presence of one of the three eyewitnesses cited in the charge sheet has not been mentioned. The Court is of the view that the said contention cannot be a ground to quash the proceedings.
7. The Court is of the view that merely because the alleged weapon held by the petitioner has not been recovered, the same cannot be a ground to quash the proceedings.
8. With these observations, the petition is dismissed.
