These writ petition have been filed for a direction, directing the respondents 1 and 2 to consider and dispose of the petitioner's representations dated 30.01.2026 and 18.12.20525 respectively and consequently to cancel the sale of Lot No.01/202-2x20 and Lot No.07/2024 respectively and to refund or credit the Earnest Money Deposit (EMD) paid by the petitioners. https://www.mhc.tn.gov.in/judis WP No. 23244 of 2026 3. It is the case of the petitioners that the petitioner is the registered buyer on the file of the second respondent e-auction platform and been participating in auction of uncleared/confiscated cargo conducted on behalf of customs. The petitioner participated in MSTC Auction and declared successful bidder under the above-mentioned lots. At the time of initial inspection, it was declared that lead content is very high and after conducting another report, it was informed that lead is only 0.76, hence, the petitioner sought to cancel the lot and to refund the EMD paid by the petitioner in WP.No.23244 of 2026. Insofar as WP.No.23246 of 2026, upon inspection it was observed that Arecanuts have a very limited remaining shelf , hence, the petitioner also sought to cancel the lot and to refund the EMD paid by the petitioner. Hence, these writ petitions. 4. Heard both sides and perused the materials placed on record. 5. Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the second respondent to consider the representations of the petitioner dated 30.01.2026 and 18.12.2025 respectively and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this Order. 6. Accordingly, these writ petitions stand disposed of.
