In this application, the petitioner has prayed for a direction upon the Court below for expeditious disposal of the interim maintenance application being Maintenance Case No.816 of 2023, presently pending before learned 2nd Judicial Magistrate, Barrackpore filed by the petitioner under Section 125 of the Code of Criminal Procedure on 05.10.2023. It is submitted on behalf of the petitioner that the said application for interim maintenance is pending for disposal for about 3 years and the petitioner being a hapless lady is suffering a lot. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, the service of copy of application upon the opposite party is dispensed with. Having considered submission made on behalf of the petitioner that the petitioner’s prayer seeking interim maintenance 2 is pending for about 3 years, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 3985 of 2026 is hereby disposed of with a direction upon the Court below to dispose of petitioner’s application seeking interim maintenance dated 05.10.2023 within a period of three months from the next date of hearing.
