The respondent nos. 3 to 7 are also represented. Learned Advocate representing the petitioner submits that the petitioner was a successful bidder in respect of a tender and had been issued work orders in respect of construction i.e., “remaining work of Deulia Flower Market within Kolaghat Panchayat Samiti in the district Purba Medinipur”. Such work order was issued on December 31, 2021. Learned Advocate representing the petitioner further submits that pursuant to receipt of the aforesaid work order, the petitioner commenced and carried out the construction work to the satisfaction of the concerned respondents. He further submits that despite the petitioner having completed the stipulated work and despite bills having been raised by the petitioner, the petitioner has not received payment of the sums due and payable to him. Such payments have been outstanding since around February, 2022. Several representations were 2 also made by the petitioner before the Zilla Parishad Authorities. However, the Zilla Parishad has not released the legitimate payment due to the petitioner till date. Learned Advocate for the respondent nos. 3 to 7 hands up a copy of a report dated September 8, 2026 prepared by the Purba Medinipur Zilla Parishad. A copy of the same is taken on record. A copy of the same has been handed over to the learned Advocate representing the petitioner. From such report, it is evident that the said Zilla Parishad is not disputing that a sum of Rs. 21, 60,074/- is due and payable to the petitioner. It is unfortunate that such payment has been due for more than four years. It is submitted on behalf of the respondents that such payment has not been made due to certain technical reasons. I have considered the rival submissions of the parties as well as the materials on record. In view of the admitted position that money is due and payable to the petitioner, this Court disposes of the present writ petition by directing the respondent no.3, i.e., the Additional Executive Officer of Purba Medinipur Zilla Parishad to pay the petitioner a sum of Rs. 21,60,074/- by October 31, 2026. Learned Advocate for the petitioner is directed to forthwith communicate this order to the Additional Executive Officer, Purba Medinipur Zilla Parishad. Since no affidavits are called for, the allegations made in the writ petition are deemed not to be admitted by the respondents. 3 Accordingly, this writ petition stands disposed of. There will be no order as to costs. All parties shall act on the server copy of this order, duly downloaded from the official website of this Court Urgent certified photocopy of this order, if applied for, be supplied to the parties upon compliance of necessary formalities.
