This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.329/2025 registered at Police Station Saraipali, District GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.04.04 13:15:49 +0530 2 Mahasamund (C.G.) for the offence punishable under Section 79 of Bharatiya Nyaya Sanhita, 2023 and Section 12 of Protection of Children from Sexual Offences Act, 2012 as per charge sheet and FIR. Under Section 296, 79 of Bharatiya Nyaya Sanhita, 2023 and Section 12 of Protection of Children from Sexual Offences Act, 2012 as per charges framed. 3. Case of the prosecution, in brief, is that the applicant used to run tailor shop which is adjacent to the house of the victim and since May 2025 used to harass the victim by using illicit and obscene language. It has also been alleged that the applicant used to send obscene message to the victim through whatsapp. 4. Learned counsel for the applicant argued that there was some property dispute between the applicant and the family of the victim and though the same was compromised in the year 2018 and the present FIR has been lodged just for the harassment of the applicant as the property in question came to the applicant. She would submit that charge sheet has been filed, the applicant is in jail since 11/02/2026 and conclusion of trial will take some time, therefore, she prays for grant of bail to the applicant. 5. On the other hand, learned State Counsel opposes the bail application and submitted that as per 183 BNSS statement of the victim which shows that there has been continuous harassment of the victim who is a minor girl aged about 14 years and the victim has been harassed by the applicant by using obscene language and showing obscene gestures. She would submit that the allegations goes to show that it cannot be a result of any false implication as the compromise which was taken place between the parties it was way back in the year 2018, 3 therefore the applicant is not entitled for grant of bail. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the statement of the victim recorded under Section 183 BNSS, which prima facie indicates continuous harassment of a minor girl aged about 14 years by the applicant through use of obscene language and gestures, looking to the gravity of the offence, this Court is not inclined to grant bail to the applicant. 8. Accordingly, the bail application of applicant Mohammad Mohsin involved in Crime No.329/2025 registered at Police Station Saraipali, District Mahasamund (C.G.) for the offence punishable under Section 79 of Bharatiya Nyaya Sanhita, 2023 and Section 12 of Protection of Children from Sexual Offences Act, 2012 as per charge sheet and FIR, is rejected. 9.
