Let the report filed by CESC Limited be kept with the records. It is submitted that the electricity meter installed in the name of the petitioner is existing and operational. However, the main switch controlling the electricity supply to the portion occupied by the petitioner was found to be in the ‘off’ position. Further, the electrical wires extending from the said main switch to the portion occupied by the petitioner on the first floor were found to be disconnected. During the course of inspection, the petitioner alleged that the private respondent, namely, Biswajit Baidya, and his family members had disconnected the electrical wiring supplying electricity to the portion occupied by the petitioner and had been frequently switching off the main
2 switch controlling the electricity supply thereto. The said allegation, however, was denied by the wife of the private respondent. CESC Limited is justified in submitting that it has complied with the order dated May 22, 2025. Accordingly, no proceeding can be initiated against CESC Limited. The learned advocate appearing for the petitioner, however, submits that, taking advantage of the fact that the main switch is installed in the portion occupied by the private respondent on the ground floor, the private respondent is deliberately switching off the main switch frequently. There is no scope to adjudicate the aforesaid issue in the present contempt application. It appears that the petitioner made an application dated August 1, 2026, before CESC Limited, requesting that the existing meter room be shifted to the portion occupied by her on the first floor of the building. CESC Limited is of the view that such shifting is not technically feasible and would severely compromise the safety and security of the entire premises. This Court is of the view that the petitioner shall be at liberty to take appropriate steps, in a separate proceeding, against the stand taken by
3 CESC Limited with regard to her application dated August 1, 2026, by filing an appropriate application. With the aforesaid observations and directions, CPAN 1418 of 2025 is disposed of. Urgent Photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
