ORDER ON BOARD 06/04/2026
1. This is the second bail application. The first bail application was dismissed on merits vide order dated 11.09.2025 in M.Cr.C. No. 6698/2025.

This bail application is filed by the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 124/2025 registered at Police Station – Hathband, District – Balodabazar - Bhatapara, Chhattisgarh for the offences punishable under Sections 137 (2), 87, 64, 64 (2) (n), 65 (1) r/w. Section 3 (5) of Bharatiya Nyaya Sanhita, 2023 and SHUBHAM DEY Digitally signed by SHUBHAM DEY
2 under Sections 04 & 06 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.
3. Case of prosecution is that, applicant took the minor sisters on his motorcycle from their village to Raipur. One of whom was aged about 12 years and another 15 years. The applicant left one victim aged 12 years at Raipur in the company of Sanjay Gendre (his nephew) and took another victim aged 15 years to Kanpur on train and left her in the company of one Rohit. During course of investigation, victims were recovered, based on their statement the applicant was arrested.

Learned counsel for applicant submits that the applicant is innocent, he has been falsely implicated in the crime. He has not committed any offence as alleged. He submits that the victims have been examined before the learned Trial Court and no such substantial allegation have been leveled by the victims against the present applicant. Applicant is in jail since 22.06.2025 and till 20.02.2026, only 06 witnesses out of 24 witnesses have been examined. Trial may take sometime, hence, applicant may be enlarged on bail.

On the other hand, learned State counsel opposes the submission of counsel for the applicant and would submit that the first bail application was dismissed on merits vide order dated 11.09.2025 and further in the deposition sheets of the victims which have been enclosed along with the bail application, it is apparent that the victims stood with their statements given to the police during the course of investigation leveling allegation against the applicant.
6. Pursuant to the notice issued by this Court, victim along with her father appeared before this Court through virtual mode from D.L.S.A. Balodabazar and she submits that she is having objection in grant of bail to the applicant.

7. I have heard learned counsel for the respective parties and perused the documents filed along with the bail application.

Taking into consideration, facts and circumstances of the case, nature of allegations, submission of learned counsel for the respective parties, documents enclosed along with the bail application and further, the deposition sheet of the victim enclosed along with the bail application, I do not find present to be a fit case to allow the application for grant of bail.
9. Accordingly, the bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is dismissed. Certified copy as per rules. Sd/- Sd/- (Parth Prateem Sahu) Judge Dey
