JUSTICE H.P.SANDESH ORAL ORDER Heard the learned counsel appearing for the petitioners; the learned counsel appearing for the State and also the counsel appearing for respondent Nos.2 to 4. 2. The prayer sought in this petition is for quashing of the entire investigation in FIR No.206/2018 arising out of PCR No.746/2018 filed by the Sub-Inspector of Police, Kumbalgudu police station, Magadi Sub Division, Ramanagar for the offences punishable under Sections 403, 404, 405, 406, 415, 418, 420, 425, 506, 120B R/W 34 of IPC against these petitioners who are accused Nos.5 to 7. 3. The learned counsel appearing for the petitioners would contend that these petitioners are nowhere connected in - 4 - HC-KAR CNR: KAHC010452312019 NC: 2026:KHC:52221 CRL.P No. 131 of 2020 the alleged offences and the allegations are only against accused No.1. The counsel appearing for the respondents/complainants also not disputes the said fact. On perusal of the PCR, it discloses that the specific allegations are made against others and not against these petitioners, who have been arraigned as accused Nos.5 to 7. Having perused the FIR also, allegations are against others for having received the amount of Rs.10,00,000/- as against the agreement for Rs.45,00,000/- and so also a suit was filed in O.S.No.4210/2017 in this regard. 4. The counsel appearing for the State would submit that based on the reference made by the Trial Court, case was registered and it requires trial. 5. Having heard the counsel appearing for the respective parties and also taking into note of the contents of the complaint and the FIR which is registered based on the reference made by the Trial Court, it discloses that in the contents of complaint in PCR No.746/2018, nothing is found against the accused Nos.5 to 7. Accused Nos.1 to 4 are the sons of late K. V. Vijayan, accused No.5 is the wife; accused - 5 - HC-KAR CNR: KAHC010452312019 NC: 2026:KHC:52221 CRL.P No. 131 of 2020 No.6 is the son and accused No.7 is the daughter of late K. V. Natarajan. When there are no specific allegations against these petitioners, the question of continuing the criminal proceedings against these petitioners does not arise. Hence, it is a fit case to exercise the powers under Section 482 of Cr.P.C. 6. In view of the discussion made above, I pass the following: ORDER (i) The petition is allowed. (ii) The proceedings initiated against these petitioners who are accused Nos.5 to 7 in Cr.No.206/2018 arising out of PCR No.746/2018 are hereby quashed. Sd/- (H.P.SANDESH) JUDGE SN
