Agarwal, A.P.P. ------ 05/ 21.01.2026 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Dumri P.S. Case No. 89 of 2024, registered for the offence under Sections 303(2), 317(5), 210, 112 of Bharatiya Nyaya Sanhita, 2023, Sections 12(1) and 12(2) of Jharkhand Bovine Animal Prohibition of Slaughter Act, 2005, Sections 11(a)(d)(k) of Prevention of Cruelty to Animal Act and Section 96 of Transportation of Animals Rule, pending in the court of learned A.C.J.M., Giridih. 3. Learned counsel appearing for the petitioner submits that the petitioner is the driver of the hywa truck. He next submits that it has been alleged that bovine animals were being carried on the said truck. According to him, the consignment was booked by another person. He further submits that the owner of the said truck has already been provided the privilege of anticipatory bail in A.B.A. No. 934 of 2025 by the co-ordinate bench of this court. 4. Learned A.P.P. has opposed the prayer and submits that in a cruel manner, the bovine animals were being transported on the [2026:JHHC:1594] -2- said hywa vehicle. 5. Considering that the petitioner is the driver of the vehicle in question and he is having no criminal antecedent and disclosure to that effect has been made in para-10 of the petition and it has been pointed out that the consignment of said bovine animals has been booked by another person, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is directed to surrender before the learned court within four weeks from today and in the event of her surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand), with two sureties of the like amount each, to the satisfaction of learned A.C.J.M. Giridih, in connection with Dumri P.S. Case No. 89 of 2024, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
