Petitioner no. 1 was also appointed as a Graduate Laboratory Instructor at the said college. He, however, was dismissed from service on January 28, 2026, during the pendency of the present writ petition. Petitioner no.2
is also presently under suspension, and it has been submitted before this Court that a disciplinary proceeding has been initiated against him. The present writ petition has been filed by the petitioners alleging, inter alia, that they have not been extended the benefit of the judgment of the Hon’ble Supreme Court passed in Civil Appeal Nos. 2903-07 of 2001 arising out of SLP Nos. 2059-60 of 1999 (Anil Ratan Sarkar & Ors. v. State of West Bengal & Ors.). Mr. Raj Mohan Chattoraj, learned advocate appearing for the petitioners, submits that the petitioners were initially extended the benefit of the aforesaid judgment. It is further submitted that the present Principal of the College, respondent no. 5, joined the College as Principal in the year 2015, whereupon all the benefits were withdrawn. Mr. Pratik Majumder, learned advocate appearing for respondent no. 5, and Mr. Vivekananda Bose, learned advocate appearing for the Governing Body of the College, submit that the petitioners have been extended all the benefits in compliance with the aforesaid judgment of the Hon’ble Supreme Court. It is submitted that the Director of Public Instruction, by an order dated May 15, 2018, granted all financial benefits to the petitioners to which they were 2
entitled, and that the said order has been duly complied with. The aforesaid stand of the College Authority has, however, been disputed by the learned advocate appearing for the petitioners.
This Court, however, is not inclined to enter into the factual disputes canvassed before it by the learned advocates appearing for the respective parties. In view of the aforesaid circumstances, the petitioners shall be at liberty to make a representation before the Director of Public Instruction for redressal of their grievance, if any. In the event such representation is made, the Director of Public Instruction shall consider the same and take an appropriate decision thereon as expeditiously as possible. Accordingly, WPA 2027 of 2016 along with CAN 1 of 2017 (Old CAN 3300 of 2017) is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings. (Kausik Chanda, J.) 3
