Item- 19. sg 21-09-2026 Ct. 6 CO 3233 of 2026 Tax Consultants Private Limited Versus Indra Kumar Mohta & Indar Kumar Mohta [ Mr. Gopal Pitti …petitioner-in-person The Director of the petitioner company appears in person and submits that a direction be passed upon the learned Judge, 3rd Bench, Presidency Small Cause Court, Calcutta to dispose of the pending applications filed in Ejectment Suit No. 63 of 2022 as well as the Ejectment Suit, expeditiously. The petitioner submits that an application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 and an application under Order 7 Rule 11 of the Code of Civil Procedure both filed by the opposite party are pending. From the order sheets appended to this application, this Court finds that hearing of the application under Order 7 Rule 11 of the Code of Civil Procedure is fixed on 29th September, 2026. In connection with the application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997, 3th July, 2026 was filed for further cross-examination of OPW-1. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned 2 advocate for the petitioner, this civil revision application is disposed of by requesting the learned Judge, 3rd Bench, Presidency Small Cause Court, Calcutta, to make an endeavour to dispose of the application under Section 7(2) of the West Bengal Premises Tribunal Act as expeditiously as possible but preferably within a period of six months from the next date filed without granting any unnecessary adjournment to either of the parties. The learned trial judge is further requested to take up the hearing of the application under Order 7 Rule 11 of the Code of Civil Procedure on the next date fixed i.e. on 29th September, 2026, if the same is otherwise ready for hearing and make an endeavour to dispose of the same as expeditiously as possible but preferably within a perod of three working months from the next date fixed without granting any unnecessary adjournment to either of the parties. After disposal of the aforesaid applications and any other applications that may be pending, the learned trial judge shall dispose of the Ejectment Suit no. 63 of 2022 as expeditiously as possible without granting any unnecessary adjournment to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities. (Hiranmay Bhattacharyya, J.)
