JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.4 in Crime No.692/2026 registered by Madanayakanahally Police Station, Bengaluru City, for the offences punishable under Sections 103(1), 115(2), 351(2), 352 and 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.692/2026 was registered by Madanayakanahally Police Station, Bengaluru City, for the aforesaid offences against the son of Devaraju and others, based on the first information dated 16.07.2026 received from Manjunatha, brother-in-law of deceased Ravi. In the - 3 - HC-KAR CNR: KAHC010582982026 NC: 2026:KHC:52678 CRL.P No. 13005 of 2026 said case, the petitioner was arrested on 17.07.2026 and in his remand application, he is arrayed as accused No.4. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.1624/2026 was rejected on 10.08.2026. Therefore, he is before this Court. 4. Material available on record would go to show that CW-1-Manjunatha and his brother-in-law Ravi, who is deceased in the present case, were both working as masons. It appears that Manjunatha and his brother-in-law Ravi had constructed a sump in the property of Devaraju (accused No.2). 5. On 16.07.2026, Devaraju had telephoned Manjunatha and informed him that the door of the sump was broken and the same was required to be repaired. Manjunatha allegedly had informed Devaraju that he would come to the site on the next day and repair the sump door. It appears that, subsequently, there was exchange of words between Manjunatha and Devaraju over the phone. - 4 - HC-KAR CNR: KAHC010582982026 NC: 2026:KHC:52678 CRL.P No. 13005 of 2026 Thereafter, at about 07.00 p.m. on the same day, Devaraju (accused No.2), who came in search of Manjunatha near his house along with three others, allegedly quarrelled with Manjunatha and thereafter, Devaraju and his son had assaulted Manjunatha. When Ravi tried to intervene, the petitioner, who was present along with Devaraju, allegedly assaulted Ravi. Thereafter, at the instance of Devaraju, his son, who is arrayed as accused No.1 in the present case, assaulted Ravi with his hands and legs on his chest and also on his private parts. As a result, Ravi fell down and was not in a position to get up. Though, he was shifted to the hospital, he died in the hospital while undergoing treatment. It is under these circumstances FIR was registered against the son of Devaraju and others. 6. It is stated that the petitioner, aged 20 years, is the friend of Devaraju's son and had come there at their request. The petitioner has no other criminal antecedents. He is in custody for the last more than two months. Major - 5 - HC-KAR CNR: KAHC010582982026 NC: 2026:KHC:52678 CRL.P No. 13005 of 2026 portion of the investigation is completed. Accused No.3, who is the other son of Devaraju and who was also present at the spot of the crime along with the petitioner, has been granted regular bail by this Court in Crl.P.No.12520/2026 on 17.09.2026. 7. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: O R D E R i) The Criminal Petition is allowed. ii) The petitioner is directed to be enlarged on bail in Crime No.692/2026 registered by Madanayakanahally Police Station, Bengaluru City for the offences punishable under Section 103(1), 115(2), 351(2), 352 and 3(5) of BNS, 2023, subject to the following conditions: - 6 - HC-KAR CNR: KAHC010582982026 NC: 2026:KHC:52678 CRL.P No. 13005 of 2026 a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE SHS List No.: 1 Sl No.: 55
