And In Re : Mamun @ Mahasin Sarkar @ Moushin Molla ... Petitioner. Mr. Kaushik Choudhury, Mr. Dwaipayan Panda ... For the Petitioner. Mr. Rajendra Banerjee, APP, Ms. Madhurai Sinha ... For the State. Learned advocate appearing for the petitioner submits that petitioner is better placed than the other accused persons who have been granted bail on 13.04.2026 in CRM(NDPS) 637 of 2026. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail, but is unable to refute the contention that there has been no recovery from the present petitioner and the only material available against the present petitioner is statement of co-accused. According to the State, there are no antecedents of the present petitioner neither there are CDRs or money trail available so far as the present petitioner is concerned. Having considered the aforesaid fact, I am of the opinion that the present petitioner viz., Mamun @ Mahasin Sarkar @ Moushin Molla be released on bail by the learned 2 Special Court/Trial Court on the same terms and conditions as the other accused persons who have been granted bail on 13.04.2026 in CRM (NDPS) 637 of 2026 (In the matter of: Imran Rahaman & Anr.). Accordingly, the prayer for bail of the petitioner is allowed. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 2000 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
