1. Affidavit of service filed on behalf of the petitioner in Court today be kept with the records.
2. The prayer of the petitioner seeking post graduate scale of pay in Physical Education subject is alleged to be pending consideration before the District Inspector of Schools (SE), Hooghly.
3. Learned advocate for the petitioner relies on the
order dated February 26, 2026 passed by this Court in WPA 29770 of 2025 (Madhumita Banerjee vs. The State of West Bengal & Ors.) wherein the Court took note of the fact that the issue has already been decided by the Three-Judge Bench of the Court in the matter of Utpal Kanti Karan & Ors. vs. State of West Bengal & Ors. reported in 2024 SCC OnLine Cal 1274.
4. Learned advocate for the petitioner submits similar prayer for grant of higher scale of pay has been allowed by the Commissioner of School Education in
2 respect of similarly placed teachers in Physical Education subject.
5. Reliance has also been placed on the reasoned
order dated May 6, 2025 taken by the District Inspector of Schools (SE), Hooghly in CPAN 223 of 2025 in W.P. No.8418 of 2019 [Sri Somnath Nandy vs. The State of West Bengal & Ors.] allowing higher scale of pay.

Without entering into the merits of the case, the instant writ petition stands disposed of by directing the concerned District Inspector of Schools to take steps to consider the prayer of the petitioner strictly in accordance with law and in line with the judgment of the Hon’ble Special Bench in the matter of Utpal Kanti Karan (supra).
7. The aforesaid respondent shall take a decision in the matter at the earliest but positively within a period of eight weeks from the date of communication of this
order.
8. If the prayer of the petitioner is allowed, then necessary steps for disbursing the arrears shall be taken without any further delay.
9. The writ petition stands disposed of.
10. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.

11. Certified server copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
