And In Re : Jorip Biswas @ Jarip Biswas @ Jarif Biswas ... Petitioner. Mr. Amitabha Karmakar, Mr. Arup Kumar Bhowmick ... For the Petitioner. Dr. Pradip Banerjee, APP, Mr. Arijit Bhusan Bagchi ... For the State. Learned advocate appearing for the petitioner submits that although the recovery in the present case is of 606 grams of Brown Sugar, but so far as the present petitioner is concerned, there has been recovery of 308 grams of Brown Sugar. Petitioner is in custody since 23.02.2026 and charge- sheet has already been submitted. It has been submitted that there is no possibility of the trial concluding in near future. As such, petitioner may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that quantum of seizure in the present case is of commercial quantity and the petitioner is having another antecedent in respect of offence under the NDPS Act. 2 Having considered the aforesaid, I am of the opinion that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, at this stage, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1807 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
