1. Heard Ms. G. Borah, learned counsel for the petitioners and also heard Mr. B. Sharma, learned Addl. P.P. for the State.
2. In this petition under Section 483 BNSS, the accused-petitioners, namely,
1. Mastak Ahmed, 2. Suhel Alom, 3. Muksedul Ali, who were arrested on 18.12.2025 in connection with Dharamtul P.S. Case No. 61/2025 under Section 303(2)/3(5)of BNS, 2023 r/w Section 11/(1)(a)/11(1)(b), Prevention of Cruelty to Animal Act, r/w Section 13(1) Assam cattle Preservation Act, is seeking bail.
3. The allegation against the present petitioners are that there are the driver and handyman of the vehicle which was intercepted by the police and 18 nos. of buffalos were recovered therefrom, one of which was already dead.
4. The petitioners were arrested on 18.12.2025, and have by now has spent 50 days in a custody.
5. Having regard to the nature of the allegation and the period of detention, the prayer for bail is allowed.
6. The accused-petitioners, 1. Mastak Ahmed, 2. Suhel Alom, 3. Muksedul Ali, shall be released on bail of Rs.50,000/-(Rupees Fifty Thousand) each with two sureties each of like amount to the satisfaction of learned trial Court in connection with the aforesaid case.
7. It is further directed that the petitioners shall co-operate with the investigation and shall not try to hamper the investigation or temper with the evidence or try to influence any witnesses connected with the case.
