Kausik (Rejected) CRM (NDPS) 1955 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kashipore PS Case No. 51 of 2025 dated 25.05.2025 under sections 20(b)(ii)(C)/29 of NDPS Act. And In the matter of : Sagar Sardar @ Surya Sardar ……Petitioner. Mr. Joy Chakraborty Mr. Sandip Dinda ……for the Petitioner. Mr. Sayak Chakraborty Mr. Rishav Kumar Thakur ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 4 months, although there was earlier direction to produce the seizure list witnesses. Till date the seizure list witnesses have not been produced before the learned Trial Court. I do not find any change of circumstances. As such, I am not inclined to release the petitioner on bail. However, State must put in efforts to produce the witnesses as was earlier directed by this Court in the order dated 8th April, 2026. All the witnesses referred to in the said order be concluded by 15th December, 2026. 2 Accordingly, CRM (NDPS) 1955 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
