The respondents are not represented despite service. Mrs. Tapasi Sinha Palit, learned advocate and Mr. Suman Chattopadhyay, learned advocate, who usually appear on behalf of the State and are present in Court today, are requested to represent the State in this matter. The concerned authority is requested to regularise their appointment in this matter. The petitioner is directed to serve a copy of this application along with annexure thereto upon them in course of this day. The petitioners allege that the private respondents are raising construction by filling up a waterbody without conversion of the same and without obtaining sanction from the concerned Panchayat. The petitioners submitted a representation in this regard before the concerned authority on August 25, 2026 which is yet to be considered. The petitioners seek consideration of the same. In view of the allegation made by the petitioners, the Pradhan, Harinarayanpur Gram Panchayat, being the 5th respondent herein, is directed to consider and dispose of the representation submitted by the petitioner dated August 25, 2026 within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
