The petitioner has filed this petition seeking the following relief(s):- “10.1 That, the Hon’ble Court may kindly be pleased to call the entire record relating to the case of the petitioner and may kindly be set aside impugned arbitrary order dated 29.09.2021 (Ann. P-1). 10.2 That, the petitioner may provide with the compassionate appointment in place of his late mother Mangli Tirki being eligible and rightful person for getting the same at the earliest. 10.3 That, the accrued salary of Late Mangli Tirki from October 2009 to September 2019 would be paid to her legal heir, in the interest of justice. Learned counsel appearing for the petitioner would submit that mother of the petitioner namely Mangli Tirki was working on the post of Peon under the respondents who died in harness on 12.09.2019. He would submit that Mangli Tirki suffered a paralytic attack on 01.10.2009 and disability certificate was also issued in her favour. He would submit that the petitioner remained in the role of respondent No. 4 as peon. He would contend that after death of Mangli Tirki, the petitioner moved an application for grant of compassionate appointment on 06.11.2019 and same has been rejected by the District Education Officer, District Balrampur- Ramanujganj without assigning sufficient reasons. He would pray to allow this petition. 3. On the other hand, learned Panel Lawyer appearing for the State/respondents would oppose. He would submit that the mother of the petitioner remained absent from service since 2009 till her death, and therefore, the application of the petitioner has been rejected. 4. I have heard learned counsel for the parties and perused the documents. 5. It is not in dispute that the mother of the petitioner was regular government servant working under respondent No. 4. She suffered a paralytic attack in the year 2009 and died on 12.09.2019. It has not been established that any departmental enquiry was initiated against her or any penalty was inflicted. Thus, it can be held that the mother of the petitioner was working continuously as government servant, and therefore, the District Education Officer committed error of law while rejecting the application moved by the petitioner for grant of 3 compassionate appointment. Consequently, the order dated 29.09.2021 (Annexure P-1) passed by the District Education Officer, District Balrampur-Ramanujganj / respondent No. 2 is hereby quashed. The District Education Officer, District Balrampur-Ramanujganj / respondent No. 2 is directed to reconsider the claim of the petitioner for grant of compassionate appointment strictly in accordance with the policy preferably within a period of 90 days from the date of receipt of copy of this order. 6.
