None appears on behalf of either of the parties. 2. No accommodation is sought for. 3. The case is pertaining to year 2023. 4. Considering the nature of prayer and long pendency of this case, this Court prefers to dispose of this revisional application on merits based on the materials available on record. 5. The prayer of the petitioner in the present revisional application is expeditious disposal of proceeding vide N.D.P.S. Case No. 87/2021 arising out of NCB Crime No. 16/NCB/KOL/2021 under Sections 8(C) read with 22(C)/23(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 pending before the learned Judge, Special Court, Narcotic Drugs and Psychotropic Substances Act–cum-Additional District Judge, 5th Court, Berhampore, Murshidabad. 6. The Investigating Agency cited as many as eight witnesses to prove the case of the prosecution. Several dates have 2 been fixed for production, appearance and evidence, but no progress. 7. In view of the above facts and circumstances, this Court finds that the accused has the fundamental right to a speedy trial under Article 21 of the Constitution of India. The prayer is simple and innocuous. Such prayer can be allowed as there is no impediment in passing such order even in the absence of the parties, considering the long pendency of this case. None would also be prejudiced. 8. The Trial Court is directed to dispose of the aforesaid proceeding as expeditiously as possible, considering the docket of the said Court independently and in accordance with law and come to a logical conclusion without granting unnecessary adjournment to the parties, if not already disposed of. 9. With the above observation, CRR/2415/2023 is disposed of. Connected applications, if any, stand disposed of. 10. Interim order, if any, shall stand vacated. 11. Let a copy of this order be communicated to the learned Trial Court for information and taking necessary action. 12. All parties shall act on the server copy of this order duly downloaded from the official website of the Calcutta High Court. 3 13.
