INDIRESH - 3 - HC-KAR CNR: KAHC010256762021 NC: 2026:KHC:50668 WP NO.13372 OF 2021 ORAL ORDER In this petition, petitioners are challenging the order dated 22nd December, 2020 (Annexure-F) passed by the respondent No.2-Deputy Commissioner in Revision Petition No.264/2019 and order dated 28th June, 2019 (Annexure-E) passed by the respondent No.3-Assistant Commissioner in Case No.R.A.(BN)140/2019. 2. Heard Sri. Siddamallappa P.M., learned counsel appearing for petitioners; Sri. Mohammed Jaffar Shah, learned Additional Government Advocate appearing for respondents 1 to 4; and Sri. Ramakrishna V., learned counsel appearing for the respondent No.5. 3. Having heard the learned counsel appearing for the parties, on careful perusal of the averments made in the writ petition, it is forthcoming that the petitioners are claiming right over the subject land based on the registered Sale Deed dated 19th June, 1967 (Annexure-A). On the other hand, the respondent No.5 is claiming right over the same based on the registered Sale Deed dated 22nd April, 1968 (Annexure-B). Therefore, taking into consideration the fact that, there are two - 4 - HC-KAR CNR: KAHC010256762021 NC: 2026:KHC:50668 WP NO.13372 OF 2021 sale deeds in respect of the subject matter of the land, I am of the view that the petitioners have to establish their right over the subject land by approaching the competent Civil Court.
