Rakib (Rejected) CRM (A) 2876 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Narayangarh Police Station case no. 206 of 2024 dated 11.09.2024 under Sections 20(b)(ii)(c)/29 of the NDPS Act and under Sections 336(3)/318(4)/3(5) of the Bharatiya Nyaya Sanhita, 2023. APP Mr. Aniruddha Bhattacharyya Mr. Chandra Gupta Kamal ……for the State. Petitioner claims that he has transferred the vehicle, to that effect a document is produced. The document is not of convincing character, as the transfer was not before the Regional Transport Authorities under the relevant provisions of law. Records reflect that in the present case 93.832 kgs of ganja were recovered, charge-sheet has been submitted. Accordingly, I am of the opinion that this is not a fit case for granting anticipatory bail. However, if the petitioner appears before the jurisdictional Court and prays for bail, learned jurisdictional Court would consider the veracity of the document on which the petitioner intends to claim that he has transferred the vehicle. 2 With the aforesaid observations CRM (A) 2876 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
