Learned HCGP accepts notice for respondent No.1. 3. Learned counsel for the petitioner would submit that the contents of the charge sheet do not disclose that ingredients of offence under Section 384 of the Indian Penal Code, 1860. 4. Learned HCGP would submit that in the complaint there is an allegation that the accused has threatened and he sent voice messages next day. The voice messages have been sent for Forensic Expert's opinion and report is still awaited. Under these circumstances, the Court is of the view that the petitioner should be permitted to file an application for discharge of such offences which according to the petitioner are not attracted, after the receipt of the FSL report by the Court. 6. Hence the following: ORDER (i) Criminal Petition is disposed of. (ii) It is made clear that the Court has not expressed anything on the merits of the matter. (iii) Till the receipt of the FSL report, the charges shall not be framed. (iv) The respondent/State shall submit the FSL report at the earliest.
