Mr. Firdous Samim, Ms. Gopa Biswas, Mr. Hasanuz Zaman Molla, Mr. Ayush Majumder, Mr. Mainak Ghosal, Mr. Hasibur Rahaman Jammader, …for the petitioner Mr. Ashim Kumar Ganguly, AGP Mr. Sudip Sarkar, …for the State It is the grievance of the petitioner that he successfully executed a work order for “Construction of PCC Road at Guniada with Guard Wall of Gopalpur Gram Panchayat” in the year 2018. Despite successful execution of the said work, the petitioner alleges that his legitimate dues have not been paid. The work order was issued by the Executive Officer, Hirbandh Panchayat Samiti. Learned Advocate appearing for the State submits that a requisition was made by the Additional District Magistrate to the Special Commissioner, Department of Paschimanchal Unnayan Affairs, for release of funds by a letter dated December 30, 2023. However, no funds have been received so far, resulting in non-payment of the petitioner’s dues. 2 In view of the aforesaid facts, I do not find any justification to keep the writ petition pending. Accordingly, the writ petition is disposed of with a direction upon the Executive Officer, Hirbandh Panchayat Samiti, to consider the claim of the petitioner within a period of three months from the date of communication of this order. If it is found that the petitioner is entitled to payment in terms of the work order executed as aforesaid, necessary steps shall be taken for release of the amount within the aforesaid period. Accordingly, the W.P.A. 29272 of 2025 is disposed of. (Kausik Chanda, J.)
