JUSTICE E.S.INDIRESH ORAL ORDER In this petition, the petitioner is challenging the Endorsement bearing No.RRT(T)CR.211/2017-18 dated 19th June, 2019 (Annexure-G) issued by the respondent No.4; inter alia sought for a direction to the respondents 1 to 4 to enter the name of the petitioner in the relevant RTC extracts pertaining to the land bearing Survey No.529 measuring 4 acre 42 cents and Survey No.530/2 measuring 25 cents situated at Maratahalli Village, Ramapura Hobli, Kollegala Taluk, now Hanuru Taluk, Chamarajanagara District. 2. Heard Sri. Gireesh M.K., learned counsel appearing for the petitioner; Sri. Mohammed Jaffar Shah, learned Additional Government Advocate appearing for respondents 1 to 4; and Sri. Kashyap N. Naik, learned counsel appearing for respondents 5 and 6. - 4 - HC-KAR CNR: KAHC010089472023 NC: 2026:KHC:50672 WP NO.3902 OF 2023 3. Having heard the learned counsel appearing for the parties, on perusal of the averments made in the writ petition, it is forthcoming that the respondent No.5 herein has preferred appeal against the M.R. No.24/2002-03 before the respondent No.3-Assistant Commissioner in Case No.R.A:155/2007-08 and same has been dismissed on 18th May, 2009 (Annexure-D) by holding that the respondent No.5 and the petitioner herein have to establish their right over the property before the competent Civil Court. The said order of the respondent No.3-Assistant Commissioner is confirmed by the respondent No.2-Deputy Commissioner , by order dated 29th August, 2016 (Annexure-E) in Case No.RA.12/2009-10. In that view of the matter, it is the duty of the respondent No.4-Tahsildar to implement the order passed by the respondents 2 and 3 and enter the name of the petitioner in the revenue records in respect of the subject land. Accordingly, I pass the following: O R D E R (i) Writ Petition allowed; (ii) Endorsement bearing No.RRT(T)CR.211/17-18 dated 19th June, 2019 (Annexure-G) issued by the respondent No.4 is hereby set-aside; - 5 - HC-KAR CNR: KAHC010089472023 NC: 2026:KHC:50672 WP NO.3902 OF 2023 (iii) Respondent No.4 is directed to implement the order dated 18th May, 2009 (Annexure-D) passed by the respondent No.3 in Case No.R.A.155/2007-08 and order dated 29th August, 2016 (Annexure-E) passed by the respondent No.2 in Case No.RA:12/2009-10, within an a period of two months from the date of receipt of this order.
