Rakib CRM (M) 2112 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Malda Police Station case no. 429 of 2025 dated 20.06.2025 under Sections 127(2)/137(2)/140(3) of the Bharatiya Nyaya Sanhita, 2023 and under Section 6 of the POCSO Act, 2012. And In the matter of : Amin Sk @ Amir Khan ……Petitioner. Mr. Sagar Saha Mr. Manjeet Saha .....for the Petitioner. Mr. Kalidas Saha ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for about one year three months, only one witness has been examined and the prosecution intends to examine about 27-29 witnesses. I have taken into account the materials appearing in the Case Diary, at this stage, I am not inclined to release the petitioner on bail before the evidence of the parents of the victim are completed. Charge-sheet reflects that CSW1 is the mother and CSW4 is the father. Learned trial Court is directed to conclude the evidence of these two witnesses within a period of three months. Petitioner would renew his prayer for bail after the evidence of these two witnesses are over. 2 At this stage, prayer for bail of the petitioner is rejected. However, learned trial Court would adhere to the direction passed above. With the aforesaid observations in CRM (M) 2112 of 2026 is disposed of. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
