Accused nos.2 & 3 in Crime No.255/2026 registered by Suryanagar Police Station, Bengaluru District, for the offences - 3 - HC-KAR CNR: KAHC010630442026 NC: 2026:KHC:52707 CRL.P No. 14189 of 2026 C/W CRL.P No. 14028 of 2026 punishable under Sections 109, 351(2), 352, 115(2) read with 3(5) of BNS, 2023, are before this Court in these two petitions filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.255/2026 was registered by Suryanagar Police Station, Bengaluru District, for the aforesaid offences against unknown persons based on the first information dated 08.08.2026 received from Pradeep who is one of the friend of the alleged victim Arjun. During the course of investigation, petitioners were arrested on 22.08.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5436/2026 was rejected on 31.08.2026. Therefore, petitioners are before this Court. 4. A reading of the first information as well as the material made available to this Court would go to show that on 08.08.2026, the first informant and his friends Arjun and Akasha had gone out to eat gobi. When they were standing after ordering their food, three persons who came there, - 4 - HC-KAR CNR: KAHC010630442026 NC: 2026:KHC:52707 CRL.P No. 14189 of 2026 C/W CRL.P No. 14028 of 2026 allegedly quarreled with them and one amongst them pulled out a knife and stabbed Arjun with the same causing grievous injuries. Thereafter, the three accused persons escaped from the spot in a two-wheeler in which they had arrived. 5. A reading of the remand application of the accused would go to show that the allegation of stabbing Arjun with a knife is found as against accused no.1. Petitioners who are arrayed as accused nos.2 & 3 were present with accused no.1 and they allegedly had instigated him to assault Arjun. It is not in dispute that petitioners do not have any criminal antecedents. Accused no.1 is said to be arrested and remanded to judicial custody in the present case. Under the circumstances, I am of the opinion that petitioners' prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.255/2026 registered by Suryanagar Police Station, Bengaluru District, for the offences - 5 - HC-KAR CNR: KAHC010630442026 NC: 2026:KHC:52707 CRL.P No. 14189 of 2026 C/W CRL.P No. 14028 of 2026 punishable under Sections 109, 351(2), 352, 115(2) read with 3(5) of BNS, 2023, subject to the following conditions: a) Petitioners shall execute personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
