ORAL ORDER Accused Nos.1 to 3 in Crime No.186 of 2026 registered by Sarjapura Police Station, Bengaluru District for the offences punishable under Section of 118(1), 118(2), 351(2), 352 read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.186 of 2026 was registered by Sarjapura Police Station, Bengaluru District for the aforesaid offences against petitioners herein, based on the

first information dated 13.07.2026 received from Nagaraju, who is the one of the victim in the present case. Apprehending arrest in the said case, the petitioners had filed Crl.Misc.No.5362 of 2026 before the jurisdictional Sessions Court, which was rejected on 27.07.2026. Therefore, they are before this Court. 4. Perusal of the material on record would go to show that accused No.1 is the son of accused Nos.2 and 3. It appears that there is a certain dispute between the accused persons and the family of the first informant, who was residing in the adjacent house. On 12.07.2026 at about 06.00 p.m., Sunanda wife of the first informant found that the water gate wall was turned off and therefore, she questioned the accused who had turned it off. 5. The accused persons, who came there stated that they had turned off the gate wall and thereafter, they assaulted Nagaraju and his family persons. In the said

incident, Nagaraju had sustained grievous injuries whereas the other victims have suffered only simple injuries. The grievous injuries suffered by Nagaraju correspond to the assault made by accused No.1 with a wooden club on his face. 6. Under the circumstances, I am of the opinion that the prayer made by the accused No.1 for grant of anticipatory bail cannot be entertained and the prayer made by accused Nos.2 and 3 for grant of anticipatory bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:
O R D E R
(i) The Criminal Petition is partly allowed. The petition insofar as accused No.1 is rejected. The petition insofar as accused Nos.2 and 3 is allowed.
(ii) The respondent - Police or any other police in the State of Karnataka are directed to release the

petitioners/accused Nos.2 and 3 in the event of their arrest in Crime No.186 of 2026 registered by Sarjapura Police Station, Bengaluru District for the offences punishable under Section of 118(1), 118(2), 351(2), 352 read with Section 3(5) of BNS, 2023, subject to the following conditions:
a) Petitioners/accused Nos.2 and 3 shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. b) Petitioners/accused Nos.2 and 3 shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) Petitioners/accused Nos.2 and 3 shall not tamper with the prosecution witness and they shall co-operate with the police for
