Rakib (Rejected) CRM (A) 2885 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Ratua Police Station case no. 18 of 2026 dated 05.01.2026 under Sections 109(1)/118(2)/126(2) of the Bharatiya Nyaya Sanhita, 2023 and adding Section 103(1) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Ajahar Ali @ Funia @ Ajahar ……Petitioner. Mr. Asfak Ahammed .....for the Petitioner. Ms. Rajashree Venket Kundalia Ms. Casunia Chatterjee ……for the State. Learned advocate appearing for the petitioner submits that there was a dispute which escalated and subsequently as the injured succumbed, petitioner is being chased unnecessarily. Petitioner is innocent and ready to cooperate with the investigation, as such, petitioner may be granted the benefit of anticipatory bail. Learned advocate appearing for the State has produced the Case Diary and referred to the dying declaration of the victim. Having considered that the petitioner is specifically named in the dying declaration, I am of the opinion that this is not a fit case for granting anticipatory bail. Accordingly, CRM (A) 2885 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
