The petitioners are apprehending their arrest in connection with Saraidhela PS Case No.01 of 2026, for offence registered under section 117(2), 126(2), 109, 303(2) 3(5) of BNS, 2023 and the matter is pending in court of learned Chief Judicial Magistrate, Dhanbad. 3. Learned counsel for petitioners submits that there are general and omnibus allegations are there against the petitioners of assault. He next submits that the petitioners are having no criminal antecedent as disclosed in paragraph no.18 of the petition and the altercation took place when the birthday party celebration was being celebrated. 4. Learned State counsel opposes prayer and submits that 2026:JHHC:6757 2 allegations are there of assault. 5. Considering that on spur of moment in the birthday party celebration the said altercation took place and pursuant to that the informant has received the injury and the petitioners have got no criminal antecedent as aforesaid and in that view of that matter, the petitioners are directed to surrender before the leraned court concerned within two weeks from today and the learned court shall release the petitioners above named on such terms and conditions and the sureties as the learned court may deem fit and proper. 6.
