The captioned petition is filed by the guarantor questioning order dated 13.09.2022 passed under provision of the 13(4) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as 'SARFAESI Act') in Crl.Misc.No.4854/2022 as per Annexure-A. Though the Hon'ble Apex Court has consistently held that the writ courts should not grant any indulgence to a default borrower, when actions are contemplated by the - 4 - HC-KAR CNR: KAHC010441872022 NC: 2026:KHC:51858 WP No. 19259 of 2022 secured creditor under the provisions of the SARFAESI Act, this Court, accepting the submission made by the counsel on record, has granted some indulgence, and the proceedings are stalled vide order dated 26.09.2022, subject to deposit of Rs.75,00,000/- in 3 installments. It is unfortunate that not a single penny is deposited in compliance with the order passed by this Court. This is a clear case of abuse of process. Though this is a fit case to impose exemplary costs, taking a lenient view, this Court refrains from imposing costs. The writ petition is not maintainable and accordingly stands dismissed.
