1. The petitioner is aggrieved that she has not been getting pension, in view of the abject apathy shown by the respondent authority. Her application is pending since 2010.
2. The report filed by the respondent no.7 after 16 years records “Accordingly, the respondents have almost completed all actions required from their end and the matter presently awaits transmission by the office of C.S.A.H.F., Salboni, to the Office of the Accountant General (A&E), West Bengal. There has, therefore, been no deliberate or wilful delay on the part of the answering respondents.”
3. For 16 years, the authorities have been unable to transmit the documents to the concerned office of the Accountant General, West Bengal.
4. The respondent authority is directed to furnish all such documents by September 30, 2026 to the office of the Accountant General (A&E), West Bengal. The Accountant General (A&E), West Bengal will take a decision in this matter by October 15, 2026 and if found eligible, will commence disbursement from October 20, 2026.
5. Since there has been a delay of almost 16 years, for no fault on the part of the petitioner, the petitioner will be entitled to interest at the rate of 6 per cent per annum from the date of her entitlement till actual payment. This rate, since the same is a reasonable rate considering the bank rate of interest on fixed deposits.
6. With the aforestated directions, the present writ petition stands disposed of.
7. There shall be no order as to costs.
8. All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court.
9. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
