Mr. Ziaul Islam Ms. Muskaan Chowdhury … for the Petitioner. Ms. Sabita Roy Ms. Sneha Chatterjee … for the State. Mr. Sunit Kumar Roy … for the NMC. Mr. Lokenath Chatterjee, Jr.SC Ms. Mary Datta … for the WBUHS.
1. The petitioner was selected for admission through NEET PG 2025 and on counselling he selected a college for admission. Unfortunately, on the day of joining, his father met with an accident for which he could not visit the college for joining. Thereafter, he applied before the authority permitting him to join but the same was not responded.
2. The petitioner prays for a direction upon the college to permit him to join the course particularly because of the reason that the said seat is still lying vacant.
3. Learned advocate representing the National Medical Commission relies upon the instruction forwarded by the Commission to all the medical institutions specially reiterating that no admission in NEET PG 2025 course shall be made beyond February
2 28, 2026. Any admission made beyond the cut-off date shall be liable for cancellation.
4. It has been submitted that the aforesaid directive of the Commission was passed relying on the order passed by the Hon’ble Supreme Court in the matter of Ashish Ranjan vs. Union of India & Ors. in WP No.76 of 2015.
5. As it appears that the Commission has already stipulated a cut-off date beyond which no admission can be made, as such, the prayer of the petitioner to permit him to take admission and join the PG course cannot be allowed.
6. The writ petition fails and is hereby dismissed.
