Mr. Utsav Dutta … For the State. State has submitted a report before this Court prepared by Inspector-in-Charge, Narayanpur Police Station. A copy of the same be handed over to learned advocate appearing for the petitioner. Petitioner has applied for cancellation of bail. Pursuant to the direction passed, the Investigating Officer of the case submitted requisition to the Superintendent of Vidyasagar Matrisadan Hospital. State has produced the case diary. The injury report reflects bleeding from lips, swelling and scratch marks. Having considered the same and that the learned Additional Chief Judicial Magistrate, Barrackpore on consideration of the said medical documents along with the statements was pleased to allow the prayer for bail by his order dated 19.03.2025, I am of the opinion that at this belated stage, it would not be proper to interfere with the said order of the learned Additional Chief Judicial Magistrate, Barrackpore; consequently, no interference is made in respect of the order of bail. 2 However, the petitioner, if he is threatened further or his rights are curtailed at the behest of the accused persons, will inform the same to the jurisdictional court presently being the learned Additional Chief Judicial Magistrate, Barrackpore and under those circumstances stringent conditions be imposed upon the accused persons. Memo of Evidence and report dated 25.08.2026 submitted by the learned advocate appearing for the State be kept with the record. Case diary be returned to the learned advocate for the State. With the aforesaid observations, the application for cancellation of bail being CRM (R) 27 of 2025 is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
