Rakib (Allowed) CRM (A) 2873 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Panskura Police Station case no. 481 of 2026 dated 27.06.2026 under Sections 3(5)/115(2)/117(2)/126(2)/303(2)/351(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25/27(1) of the Arms Act, 1959. And In the matter of : Abhijit Pradhan @ Avijit Pradhan @ Abhijit & Anr. ……Petitioners. Mr. Satadru Lahiri Mr. Syed Wasim Faruque ......for the Petitioners. Mr. Kallol Kumar Basu Ms. Priyanka Chandra Ms. Pramita Banerjee ……for the State. Learned advocate appearing for the petitioners submit that petitioners are foisted with number of cases pursuant to political rivalry. Mr. Basu, learned advocate appearing for the State opposes the prayer for anticipatory bail. I have taken into account the injury report. Having considered the attending circumstances and the materials which are appearing in the Case Diary, I am of the opinion that on stringent conditions petitioners be granted the benefit of anticipatory bail. As such, prayer for anticipatory bail of the petitioners namely, (1) Abhijit Pradhan @ Avijit Pradhan @ Abhijit and (2) Ramkrishna Sahoo is allowed. Accordingly, in the event of arrest, the petitioners shall be released on bail to the satisfaction of the Arresting Officer on such 2 terms and conditions as he deems fit and proper subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioners shall report to the Investigating Officer of the case within a period of ten days and thereafter, on all subsequent dates fixed by the Investigating Officer of the case for the sake of investigation till the report in final form is submitted before the jurisdictional Court. Additionally, if the investigating officer is of the opinion that presence of the petitioners in the locality may cause breach of the peace, in that case, an application be taken out before the learned Chief Judicial Magistrate, Tamluk, learned Chief Judicial Magistrate, Tamluk under those circumstances pass specific direction to stay outside the jurisdiction of Panskura Police Station upon the petitioners. Accordingly, CRM (A) 2873 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
