PP, CBI … for the CBI Learned counsel appearing on behalf of the appellant submits that the appellant does not want to press this appeal. He relies on the written instruction issued by the executant/sister of the appellant in this regard. Learned counsel appearing on behalf of the CBI submits that earlier an application filed on behalf of the appellant was rejected by a Co-ordinate Bench of this Court on 23.02.2026. This appeal challenges an order dated 03.07.2026 passed by the learned Judge Exclusive (POCSO) Court, Purba Bardhaman Sadar in connection with Sessions (P) Case No. 63 of 2025, thereby rejecting the prayer for bail made on behalf of the appellant. 2 The present application is under Section 14-A (2) of the SC & ST (POA) Act and the same does not relate to the restrictions contained in Section 484 of the Cr.PC corresponding to Section 425 of the BNSS as regards summary dismissal of an appeal. Therefore, on the prayer of the learned counsel appearing on behalf of the appellant, the appeal being CRA (SB) 128 of 2026 is dismissed as withdrawn.
