Shah ……for the State. Learned advocate appearing for the petitioner submits that the chemical examiner’s report reflects that the percentage of codeine in the mixture which was subject matter of test could not be ascertained and to that effect there is specific assertion in the deposition of the chemical examiner. Petitioner is in custody for more than two years six months. There is issue relating to the seizures having been made. Learned advocate appearing for the State opposes the prayer for bail and submits that the evidence of the case is in progress, there are antecedents of the present petitioner and so far as the present case is concerned, there are materials to confirm regarding the complicity of the present petitioner. Be that as it may, petitioner is in custody for more than two years six months. State would complete rest of the witnesses within a period of six months from date. 2 In the alternative, if a bail application is filed after the time period is over, learned Special Court would leniently consider such bail application of the petitioner. With the aforesaid observations CRM (NDPS) 1950 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
