1. The instant bail application has been filed under Section 483 BNSS, 2023 on behalf of the accused-applicant. The accused- applicant was arrested in connection with FIR No. 96/2024 registered at Police Station Tijara, District Bhiwadi for the offence(s) under Sections 365, 376-D, 376, 506 of IPC.

Learned counsel for the accused-applicant has submitted that the applicant is a young person, aged about 28 years, comes from a humble background. It is also submitted that the applicant is the sole bread earner of his family. It is further submitted that the charge-sheet has already been filed in the matter which is not supportive of the case of the prosecution in entirety. It is lastly submitted that there are no criminal antecedents registered against the applicant.

3. Per contra, learned Public Prosecutor has vehemently opposed the instant bail application.

Having heard the arguments advanced by learned counsel for the parties, taking note of the fact that the applicant is a young person, aged about 28 years; that the applicant is the sole bread earner of his family; that the charge-sheet has already been filed in the matter; that there are no criminal antecedents against the applicant, and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail.

Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Irfan S/o Shri Akbar shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
